Residence permit

Residence permit refused or expired: what should you do?

Residence permit (ikamet izni) problems can lead to a deportation decision. The deadlines are short; the sooner you act, the more options you have.

Critical deadlines

After the permit expires
10 days
After an extension is refused
10 days
Case against a refusal
60 days

The law provides that a deportation decision can be made for those who stay in Türkiye for more than 10 days after their residence permit expires without an acceptable reason, those who do not leave the country within 10 days after their extension application is refused, and those whose residence permit is cancelled (Law No. 6458, Art. 54).

Because no special time limit is set for refusal or cancellation decisions, under the general rule a case can be filed against them at the administrative court within 60 days of written notification (Administrative Procedure Law (İYUK), Art. 7).

For a deportation decision, the deadline is 7 days

If a deportation decision has also been notified, the deadline for a case against it is 7 days.

What is your situation?

  1. Application or extension refused

Depending on the reason for the refusal, a new application, an objection or a court case is considered. If an extension application was refused, do not miss the 10 days given to leave in the meantime.

  2. Permit cancelled

A cancellation decision can lead to a deportation decision and an entry ban. The reasons for the decision and the date it was notified (tebliğ) are decisive.

  3. Permit expired, no application made

The longer the violation lasts, the higher the administrative fine and the longer the entry ban. You need to know from the start how leaving on your own, paying the fine and the entry ban are connected.

How it relates to entry bans

For visa or residence violations, the length of the entry ban depends on how long the violation lasted and whether the fine was paid. You can find the table of periods on the entry ban codes page.
